Amicable Settlement Guides: What You Need to Know<\/span><\/h1>\n

Following a minor road accident, many drivers choose to fill out an amicable statement form. But what do you do if misunderstandings arise in the meantime? Can you still go to the Police? The answer is not always simple, but you can find out more useful information below. \ud83d\udcdd \ud83d\udc47<\/p>\n

  1. \ud83e\udd1d A signed amicable statement has legal value<\/b> and does not allow the Police to be involved later.<\/li>\n
  2. \ud83d\ude94 You can go to the Police only in exceptional cases<\/b>, if suspicions or fraud arise.<\/li>\n
  3. \u203c\ufe0f<\/b> The type of RCA or Casco insurance<\/b> can influence what options you have.<\/li>\n<\/ol>\n

    \ud83d\udea8 If you have made an amicable statement, can you still go to the Police? Here’s what you need to know!<\/h2>\n

    \ud83d\udcdd The amicable is a legally recognized act<\/b><\/h3>\n

    Once signed and completed correctly, the amicable finding has legal value. It is equivalent to an official declaration before the Police.<\/p>\n

    \u274c After signing, the Police no longer intervene<\/b><\/h3>\n

    If both parties agreed and signed the form, the Police can no longer intervene. The exception is cases in which one of the parties later disputes the content.<\/p>\n

    \ud83d\udcf7 Additional evidence can count<\/b><\/h3>\n

    If there are suspicions that one of the parties lied on the form, you can go to the Police with evidence – witnesses, videos, photos. However, this does not guarantee that a criminal or contraventional case will be opened.<\/p>\n

    Without the signature of both drivers, the amicable settlement is not valid. In this case, you are obliged to contact the Police.<\/p>\n

    If you have entered essential information incorrectly (date, place of accident, vehicle details), the form may be considered invalid. This mistake forces you to go to the Police later.<\/p>\n

    If the accident only resulted in scratches or minor bumps and both parties agree, amicable is ideal. You save time and avoid bureaucracy.<\/p>\n

    \ud83d\udc4f No victims<\/b><\/h3>\n

    Amicable can only be used if there were no injuries. Any bodily injury, no matter how minor, requires calling the Police.<\/p>\n

    \ud83d\udee3\ufe0f The accident occurred in a public space<\/b><\/h3>\n

    If the accident occurred on public roads, and not on private property, amicable is recognized by all insurance companies.<\/p>\n

    \ud83c\udfc3\u200d\u2640\ufe0f You are in a hurry and want a quick solution<\/b><\/h3>\n

    If you are in a hurry or have a busy schedule, completing an amicable is much more efficient than waiting in line at the Police.<\/p>\n

    \ud83d\udcd1 Have all the documents with you<\/b><\/h3>\n

    For a valid amicable settlement, you must have your license, registration certificate and RCA policy with you. If they are missing, you cannot legally conclude the amicable settlement.<\/p>\n

    \ud83d\udcf8 You took pictures at the scene of the accident<\/b><\/h3>\n

    If you have visually documented the position of the cars, the damage and the license plates, you have a good basis for correctly completing the amicable settlement.<\/p>\n

    \ud83d\ude93 In what contexts is it more recommended to notify the Police?<\/h2>\n

    \u26d4 There are victims in the accident<\/b><\/h3>\n

    If someone was injured, it is mandatory to notify the Police. Any amicable settlement in this case is null and void.<\/p>\n

    \ud83e\uddfe The other party does not have valid RCA<\/b><\/h3>\n

    If the other driver does not have RCA insurance, go directly to the Police. You cannot obtain compensation through an amicable settlement.<\/p>\n

    If you feel increased tension, verbal or physical aggression, it is safer to call the Police. It is better to let the authorities intervene.<\/p>\n

    The amicable finding is only valid for accidents with two vehicles. For three or more, a report issued by the Police is required.<\/p>\n

    If you suspect that the other driver is under the influence of alcohol or prohibited substances, contact the Police immediately. Only they can perform the necessary tests.<\/p>\n

    Even though it is tempting to act amicably, some insurance companies do not recognize accidents on private property without an official document. The police can issue a certificate that supports the file.<\/p>\n
