Contractual liability: conditions and exemptions

For compensation to be awarded, four elements must be established cumulatively: the act or omission, including non-performance or defective performance, the loss suffered by the contractual partner, the causal link between the act and the loss, and the insured’s fault. The absence of any one of these elements may lead to exemption from contractual liability.

Pure financial losses that do not arise from a distinct service contract are generally addressed separately through general liability insurance, which complements contractual liability insurance.

    For professional activities, errors, omissions or incorrect advice may require a separate professional liability policy, while pure financial losses are covered only when expressly provided for in the insurance contract.

    Property damage, bodily injury, certain financial losses, defence costs and other eligible expenses, depending on the wording of the policy.

    Examples of liability limits

    In practice, the limit may be set per occurrence and/or as an annual aggregate. As indicative examples, limits of EUR 100,000, EUR 500,000 or EUR 1,000,000 may be available depending on the activity, contracts and exposure. The actual limit is the one stated in the policy.


    It is also important to review sub-limits, deductibles, exclusions, the territory of coverage and the insured period. For example, a policy may have an overall limit of EUR 500,000 but a lower sub-limit for certain types of loss.
