This procedure is the fastest solution for resolving damages and can be done without the intervention of the police.

Since small unpleasant events happen quite often in traffic, it is good to know exactly the conditions under which you can conclude a friendly car, which are the necessary documents and what the whole procedure entails. If you are an experienced driver, you probably already know that road accidents are sometimes unavoidable. Even if they are minor, they can become stressful because of the time lost at the police. The good news is that minor accidents can be resolved much more simply if the two drivers involved understand each other and opt for an amicable settlement.

The amicable finding is a simplified procedure for solving road accidents without victims. This saves you from going to the police, but it can only be concluded if both parties involved in the accident agree and fill out the form. 2.1. The procedure of an amicable settlement in the event of an accident

When you are involved in a minor accident resulting in only material damage, it is good to know exactly what steps to follow. 2.2. How to correctly complete the amicable agreement in case of minor accidents?

The amicable finding must include both the identification data of the cars, as well as detailed information about the event that took place. When it is filled out correctly, the damage file will be able to be solved much faster.

The amicable agreement must be completed with a blue pen and in capital letters by both drivers. If there were witnesses to the road accident, they can be entered in field number 5 of the form, along with their address and phone number. Of course, the witnesses must not know any of the drivers involved in the accident.

The same copy of the amicable agreement must be completed by both drivers and must include two self-copy sheets, so that each of them can keep a copy.

The amicable finding form contains several important areas such as:

  1. The upper part that must be completed with the date and time of the event;
  2. The location where the accident happened – city, street number or name of the intersection;
  3. On the bodily injuries part, the NO box must be ticked;
  4. In the area where material damage is mentioned to vehicles other than those involved or to other objects, check the NO box;
  5. Point 5 must be completed with the witnesses at the scene of the accident if they exist.
  6. Then follows the part colored in blue, which must be completed by the guilty driver. Several data are required here, such as the insured’s name, address, telephone number, make and type of vehicle, registration number, as well as details about the insurance company. The last point must be completed with the data of the driver of the vehicle at the time of the accident.
  7. The yellow part on the right will be completed by the driver of the damaged car. This contains the same information as the blue area.
  8. In the amicable finding form, there is also the middle part, which refers to the circumstances of the accident. Here, only the corresponding boxes that apply to the produced event must be ticked.
  9. At the bottom of the form there is also an area dedicated to making a sketch of the accident. This is mandatory and can be completed by any of the drivers involved. What is really important is that the sketch reproduces what happened as well as possible.
  10. The last parts of the form contain the additional comments and the signatures of the parties involved.

It should be mentioned that the first five points can be completed by any of the drivers involved in the accident, but the following will be different. Thus, the author of the accident fills in the blue part, and the one who is not guilty in the yellow part.

Completing an amicable car can be done in physical format or, more recently, there is also the possibility of using an online application, through which the form can be accessed very easily. The application is a result of the partnership between the Bureau of Motor Vehicle Insurers from Romania and ASF and represents a method as safe and with the same legal value as the printed document.

The amicable finding can be completed from a phone by creating an account in the application. The following steps are similar to filling out a printed form:

  • Introduction of personal data and car identification data. In case you have another accident, this information is automatically taken from the electronic form.
  • Complete the details related to the occurrence of the accident, respectively the damages caused, but also the damages suffered by the personal car. It should be mentioned that the location will be retrieved via GPS, therefore this information is no longer necessary as in the case of a document in physical format.
  • Photos can be entered in the application and the sketch of the accident can be created.
  • The last step is to sign and send the form to the insurance company.

In order to have an amicable finding form, the other driver involved must download the application and scan a QR code.

2.3. What documents are necessary for the amicable agreement?

After the amicable finding form is completed, it must be submitted to the insurance company within 24 hours of the occurrence of the event. In order to complete this step as well, it is recommended to have with you several copies of important documents, which attest to the correctness of the data relating to the other driver involved. Among them are:

  • Identity card;
  • The permit;
  • The registration certificate;
  • RCA policy.
